These Terms of Use ("Terms") govern your access to and use of the Viral Patterns mobile application, website, support channels, and related services (collectively, the "Service"). The Service is operated by Viral Patterns LLC ("Viral Patterns," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Viral Patterns is an AI-assisted language learning app. The Service may include:

  • Live speaking practice.
  • AI tutor and avatar conversations.
  • Speech recognition and transcription.
  • Pronunciation, grammar, vocabulary, fluency, and progress feedback.
  • Guided lessons and role-play scenarios.
  • Personalized learning plans.
  • Push notification reminders.
  • Subscription features and premium access.
  • Account, settings, support, and purchase restoration tools.

We may change, add, remove, pause, or discontinue parts of the Service at any time.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

You are responsible for making sure your use of the Service is lawful in your location.

Accounts

You may use the app with an anonymous guest account or by signing in with supported providers such as Apple or Google. Some features may require an account, active subscription, internet connection, or device permissions.

You are responsible for:

  • Keeping your account secure.
  • Providing accurate account information.
  • Maintaining access to your Apple ID, Google account, or other sign-in method.
  • All activity that occurs through your account.

Device Permissions

Some features require device permissions. Depending on the feature, the app may request access to:

  • Microphone, for speaking practice, live conversations, pronunciation feedback, and speech processing.
  • Speech recognition, for converting practice speech into text and lesson feedback.
  • Camera, if a released feature asks for camera access for video/avatar functionality.
  • Notifications, for reminders and learning updates.
  • Tracking permission, if requested by iOS for permitted personalization, analytics, or product improvement uses.

You can grant, deny, or revoke permissions through iOS Settings. Some features may not work without the permissions needed for that feature.

Subscriptions, Purchases, and Billing

Viral Patterns may offer auto-renewable subscriptions, free trials, promotional offers, or other in-app purchases.

Purchases made in the iOS app are processed by Apple through your Apple ID. Apple handles payment processing, billing, renewal, cancellation, refunds, taxes, and payment disputes according to Apple's terms and policies.

Unless canceled, auto-renewable subscriptions renew automatically. Your Apple ID may be charged for renewal within the period described by Apple before the current subscription period ends. You can manage or cancel subscriptions in your Apple ID subscription settings.

Deleting the app does not cancel a subscription. You must cancel through Apple subscription settings if you do not want the subscription to renew.

Access to paid features may depend on successful payment, valid entitlement status, App Store purchase status, RevenueCat entitlement status, and Superwall paywall configuration.

Refunds

For purchases made through the App Store, refund requests are handled by Apple. We do not control Apple's refund decisions. You can request help with Apple purchases through Apple's purchase support tools.

AI Features and Learning Feedback

The Service uses AI, speech processing, and automated analysis to provide language tutoring, feedback, transcripts, translations, explanations, and recommendations.

AI-generated content may be inaccurate, incomplete, offensive, delayed, or unsuitable for a particular purpose. You should review and use your own judgment before relying on any AI-generated output.

The Service is for educational and language practice purposes only. It does not provide legal, medical, financial, immigration, professional, emergency, or other regulated advice.

Do not submit highly sensitive personal information, confidential information, passwords, payment card numbers, private health information, or information about other people during lesson conversations.

User Content

"User Content" means information, text, audio, speech, transcripts, messages, support requests, preferences, and other content you provide or generate through the Service.

You retain ownership of your User Content. You grant Viral Patterns a worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce, process, analyze, display, and use User Content as needed to:

  • Provide and operate the Service.
  • Generate lessons, transcripts, AI responses, and feedback.
  • Personalize learning.
  • Maintain progress history.
  • Improve safety, reliability, and product quality.
  • Provide support.
  • Comply with law and enforce these Terms.

You represent that you have the rights needed to provide your User Content and that your User Content does not violate law, these Terms, or the rights of others.

Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, abusive, fraudulent, or deceptive purposes.
  • Harass, threaten, impersonate, exploit, or harm another person.
  • Submit content that infringes intellectual property, privacy, publicity, or other rights.
  • Upload malware, attempt unauthorized access, interfere with systems, or bypass security controls.
  • Scrape, copy, resell, sublicense, or commercially exploit the Service without permission.
  • Reverse engineer, decompile, modify, or create derivative works from the app except where law expressly permits.
  • Use the Service to create spam, scams, misleading content, or automated abuse.
  • Use AI features to generate illegal, harmful, or rights-infringing content.
  • Misrepresent your identity, age, account status, subscription status, or affiliation.

We may suspend or terminate access if we believe you violated these Terms or created risk for Viral Patterns, users, service providers, or third parties.

Intellectual Property

The Service, including software, design, interfaces, text, graphics, logos, lesson structure, features, models of interaction, and other materials, is owned by Viral Patterns LLC or its licensors and is protected by intellectual property laws.

These Terms do not transfer ownership of the Service to you. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own lawful language learning purposes, subject to these Terms and applicable app store rules.

Third-Party Services

The Service depends on third-party platforms and service providers, including app stores, authentication providers, cloud infrastructure, analytics providers, crash reporting providers, subscription providers, live audio/video providers, AI providers, speech processing providers, and text-to-speech providers.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control, but we use them to operate and improve the Service.

App Store Terms and Apple EULA

If you download the app from the Apple App Store, your use of the app is also subject to Apple's applicable App Store terms.

Unless we provide a custom end user license agreement through App Store Connect, Apple's Standard End User License Agreement applies to the app. Apple's Licensed Application End User License Agreement is available at:

Apple is not responsible for providing maintenance or support for the Service. Viral Patterns LLC is responsible for support as described in these Terms and on our Support page.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the iOS app. Upon your acceptance of these Terms, Apple has the right to enforce the applicable App Store-related provisions against you as a third-party beneficiary.

Privacy

Our Privacy Policy explains how we collect, use, share, and protect information. By using the Service, you also agree to the processing described in our Privacy Policy.

Availability and Changes

The Service may be unavailable from time to time because of maintenance, updates, network issues, third-party outages, or other reasons. We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

We may update the app, change features, change prices for future subscription periods, remove content, or modify these Terms. If changes are material, we may provide notice through the app, website, or other reasonable means.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

We do not guarantee that:

  • AI responses will be correct.
  • Speech recognition or pronunciation analysis will be accurate.
  • Progress scores will reflect real-world language ability.
  • The Service will meet your expectations.
  • Errors will be corrected.
  • The Service will be free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, Viral Patterns LLC and its owners, employees, contractors, service providers, licensors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the amount you paid to Viral Patterns through the Service in the 12 months before the event giving rise to the claim, or USD $100 if you paid nothing.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you.

Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Viral Patterns LLC and its owners, employees, contractors, service providers, licensors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from:

  • Your use or misuse of the Service.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of law or third-party rights.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if we believe you violated these Terms, created risk, caused harm, or used the Service unlawfully.

After termination, provisions that by their nature should survive will survive, including intellectual property, privacy, disclaimers, limitation of liability, indemnification, and dispute provisions.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles, except where local consumer protection laws require otherwise.
